Cancellation of Purchase Agreement Registration in Northern Cyprus

Sometimes it becomes necessary to cancel a previously registered property purchase agreement. This situation most often occurs in transactions without a title, when the title still remains with the developer. The cancellation process requires the participation of all parties and following procedures at both the Land Registry and the Tax Office.

How is the agreement cancelled?

1. Cancellation at the Land Registry

To remove the registration of a purchase agreement at the Land Registry, the presence of all parties is required:

  • the buyer,
  • the seller,
  • the registered title holder (usually the developer).

Important: the original purchase agreement registered at the Land Registry must be provided.

All parties simultaneously approach the Land Registry and sign a cancellation application. After that, the agreement registration is annulled.

2. Cancellation at the Tax Office

Previously, cancellation at the Land Registry was sufficient, but now cancelling registration at the Tax Office is also mandatory.

The process at the Tax Office is more labor-intensive and requires:

  • the original purchase agreement,
  • SSK extract from the Land Registry,
  • all receipts paid during registration (stamp duty, 6% tax),
  • invoices (faturas) that the developer may have issued for the property.

Why is it important to keep documents?

All original documents and receipts are needed for cancellation. Losing them can significantly delay the process.

We always recommend clients to keep:

  • the SSK extract from the Land Registry,
  • receipts of stamp duty payments,
  • tax receipts.

For the Land Registry:

  • original purchase agreement,
  • power of attorney (if owners act through a representative),
  • personal presence of the parties (in Girne, the power of attorney must be submitted in advance; in Famagusta and Nicosia, presence is possible without it).

For the Tax Office:

  • original purchase agreement,
  • SSK extract from the Land Registry,
  • all receipts for taxes and stamp duty,
  • invoices (faturas) from the developer.
